Luventix Inc. (“Luventix,” “we,” “us,” “our”) respects your privacy and values your trust. The purpose of this Privacy Policy is to inform you of the treatment and handling of personal information that we may learn about you from using our website at www.luventix.com (the “Site”), from purchasing products and services from us or engaging with our content, or by use of any of our services (collectively, the “Service”). 2. Agreement to Terms

If you do not agree with the terms of this Privacy Policy and our Terms of Use, then you should immediately discontinue use of the Service without providing us with any personal information.

3. Information We Collect

We may collect the following categories of personal information (a) directly from you (such as when you create an account, respond to a survey, or otherwise interact or communicate with us), (b) from the device and browser that you use to access the Service, and (c) from cookies and similar technologies.

Identifiers
We may collect your first name, last name, email address, account username and password, postal address, phone number, physical characteristics or description, and health insurance information.

Commercial Information
We may collect your order history.

Demographics and Characteristics
We may collect your age/birthdate, race or ethnicity, sex, gender, gender identity, and gender expression.

Health Information
We may collect information about your health background, health status, physical or mental disability or medical condition, and sex, including pregnancy, childbirth, or medical condition related to gender.

Device Information
We may collect device information when you visit our Site. Device information may include your device type, browser type, online and/or unique identifiers, and IP address.

Internet Activity
We may collect information concerning your interaction with the Site, including when you access the Site and your browsing activity on the Site (such as which pages you visit, in what order, and for how long). This may also include “traffic data” or tracking information provided by the Site’s host or similar providers (e.g., Google Analytics) that may be helpful for marketing purposes or for improving the Site and App.

Other
We may collect information that you provide in response to surveys or questionnaires. You are not required to provide all personal information identified in this Privacy Policy to use our Service or to interact with us, but certain functionality will not be available if you do not provide certain personal information. For example, if you do not provide certain personal information, we may not be able to register an account or respond to your requests.

4. Confidentiality of Health Information

We are a medical research and diagnostics company that has developed a testing platform to assist in determining the probability that an individual has, or is likely to develop, certain illnesses. In order to provide our Service, we work with clinical research organizations, healthcare providers and health insurance providers. These entities may provide personal information, including health and medical information, about their patients to us in connection with their use of the Service. These entities are directly responsible to their patients for the use and disclosure of patient health or medical information.

Health information that Luventix receives and/or creates about you, personally, relating to your past, present, or future health, treatment, or payment for healthcare services, may be “protected health information” or “PHI” under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) and the Health Information Technology for Economic and Clinical Health Act (“HITECH Act”). Your health information may also be protected by state privacy laws and regulations.

Luventix understands that health information about you and your health is personal. We support your privacy and make sure that transmittal and use of your information complies with all laws. In this regard, where applicable, we comply with HIPAA, the HITECH Act, and other relevant state laws and regulations by entering into Business Associate Agreements with the entities for which we provide services to ensure that your protected health information is appropriately safeguarded.

While each treatment provider may have its own Notice of Privacy Practices, we have included Luventix’s notice below. Please contact each treatment provider for more information regarding its own privacy practices.

5. Cookies

We store certain information that gets collected automatically at our end through cookies and other similar technologies. A cookie is a small string of information that a website that you visit transfers to your browser for identification purposes. Cookies can be used to follow your activity while using a website or across websites, and that information helps companies understand your preferences and tendencies, as well as improve and personalize your website experience. Some cookies are necessary to operate a website, while others can be functional, analytical, or used for marketing purposes (as discussed in more detail below). Cookies on the Site are generally divided into the following categories:

  • Strictly Necessary Cookies. These are required for the operation of the Site. They include, for example, cookies that enable you to log into password-protected portions of the Site. These cookies are session cookies that are erased when you close your browser.
  • Analytical/Performance Cookies. These allow us to recognize and count the number of visitors to the Site and understand how such users navigate through the Site (e.g., when and which pages are visited, in what order the pages are visited, and where a user is located).  We also use Google Analytics and HubSpot Analytics for part of this process. For example, cookies are used to remember that you have previously visited the Site and asked to remain logged into it (e.g., this saves your username). These cookies qualify as persistent cookies because they remain on your device for use during your next visit to the Site. You can delete these cookies as detailed below.

Third Party Cookies
In addition, we use third party software and  e-commerce services like 1health.io and Shopify to power our online test ordering and online stores. These services use- certain strictly necessary cookies to enable the online store to function properly as well as analytical/performance cookies. You can also prevent the use of certain cookies by modifying your Internet browser settings, typically under the sections “Help,” “Internet Options,” or “Settings.” If you disable or delete certain cookies in your Internet browser settings, you may still access our Site, however, you might not be able to access or use important functions or features of our Site, and you may, for example, be required to re-enter your log-in details.

Do-Not-Track Signals
At this time, we do not recognize automated “do-not-track” browser signals.

6. Children's Privacy

The Service is not intended for users under the age of 16 and Luventix does not knowingly collect personal information from individuals under the age of 16. If you are aware of, or suspect that, someone under the age of 16 is using the Service without permission, please notify us immediately by contacting us as detailed in the How to Contact Us section below. 7. Our use of Personal Information

We collect and use your personal information for the following purposes:

  • Providing the Service to you and providing products or services requested by, or reasonably anticipated within the context of our relationship with, you;
  • Managing our relationship with you, and responding to your inquiries or requests, and requesting feedback;
  • Analyzing use of the Site;
  • Keeping track of your shopping cart;
  • Keeping track of your login name and password;
  • Detecting security incidents and protecting against malicious, deceptive, fraudulent, or illegal activity, or prosecuting those responsible; and
  • Complying with legal and regulatory obligations.

8. Our Disclosure of Personal Information

We may share your personal information with the following third parties:

  • Service providers, including hosting, technology and communication providers, security and fraud prevention consultants, and payment processors (including Paypal, Shopify, and Stripe). In some instances, service providers will be directly responsible to you for their use of your personal information. They may be obliged by law to provide you with additional information regarding the personal information that they hold about you and how and why they process that information. Further information may be provided to you in a separate notice or may be obtained from such service providers directly, for example, via their websites.
  • Healthcare and health insurance providers. With your explicit consent and approval, we may share Health Information with healthcare providers and/or health insurance providers.
  • Advisers and financial institutions, including auditors, notaries, business continuity support service providers, and legal, tax, and risk and compliance advisors.
  • With third parties in connection with a change to the control or financial status of the company, including a corporate restructuring, sale, acquisition, financing, reorganization, bankruptcy, receivership, transfer, assignment of assets, or business merger or divestiture. Personal information and other information may be shared in the diligence process with counterparties and others assisting with the transaction and transferred to a successor or affiliate as part of that transaction.
  • Government bodies, dispute resolution organizations, law enforcement agencies, or third parties in connection with (a) responding to a subpoena, search warrant, or other lawful request for information that we receive; (b) cooperating in a law enforcement or similar investigation; or (c) otherwise protecting our rights, as applicable.

9. Your Privacy Choices

If you no longer want to receive our newsletter, emails, or other marketing communications, you may unsubscribe at any time by following the “unsubscribe” link at the bottom of our emails or by logging in to your account and selecting the opt-out option.

To opt-out of text messages, you may text “STOP” in reply to any Luventix marketing text message.

Please note that you cannot unsubscribe from certain correspondence from us, including messages relating directly to your account or purchases placed through the Site.

If you have created an account, you may review, amend, and/or delete certain personal information that we have collected about you by logging in to your account.

10. Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

This HIPAA Notice of Privacy Practices (the “Notice”) contains important information regarding your medical information. Luventix is dedicated to maintaining the privacy of your protected health information (“PHI”). PHI is information about you that may be used to identify you (such as your name, social security number or address), and that related to (a) your past, present or future physical or mental health or condition, (b) the provision of healthcare to you, or (c) your past, present or future payment for the provision of healthcare. In conducting its business, Luventix may receive and create records containing your PHI. Luventix is required by law to maintain the privacy of your PHI and to provide you with notice of its legal duties and privacy practices with respect to your PHI.

Luventix must abide by the terms of this Notice while it is in effect. This Notice is in effect from the date noted above until Luventix replaces it. Luventix reserves the right to change the terms of this Notice at any time, as long as the changes are in compliance with applicable law. If Luventix changes the terms of this Notice, the new terms will apply to all PHI that Luventix maintains, including PHI that was created or received before such changes were made. If Luventix changes this Notice, it will post the new Notice on its Site and will make the new Notice available upon request.

Uses and Disclosures of PHI
As permitted under HIPAA, the following categories explain the types and uses and disclosures of PHI that Luventix may make. Some of the uses and disclosures described may be limited or restricted by state laws or other legal requirements, for example, the Clinical Laboratory Improvement Amendments of 1998 (“CLIA”). Please contact our Privacy Officer, using the contact information provided at the end of this Notice, for specific information regarding your state.

Luventix may use and disclose your PHI in the following ways:

  • Treatment, Payment and Healthcare Operations. Luventix is permitted to use and disclose your PHI for purposes of (a) treatment, (b) payment and (c) healthcare operations. For example:
  • Treatment. Luventix may use or disclose PHI for diagnostic and treatment purposes, including disclosure to physicians, nurses, medical students, pharmacies, and other health care professional who provide you with health care services and/or are involved in the coordination of your care, such as providing your physician with your laboratory test results.
  • Payment. Luventix may use or disclose PHI to bill and collect payment for laboratory testing and other services we provide. For example, Luventix may provide PHI to your health plan to receive payment for the health care services provided to you.
  • Healthcare Operations. Luventix may use or disclose PHI for healthcare operations purposes. These uses and disclosures are necessary, for example, to evaluate the quality of our laboratory testing, accuracy of results, accreditation functions and for Luventix’s operation and management purposes. Luventix may also disclose PHI to other health care providers or health plans that are involved in your care for their health care operations. For example, Luventix may provide PHI to manage disease, or to coordinate health care or health benefits.
  • Authorization. Luventix is permitted to use and disclose your PHI upon your written authorization, to the extent such use or disclosure is consistent with your authorization. You may revoke any such authorization at any time.
  • As Required by Law. Luventix may use and disclose your PHI to the extent required by law.
  • Special Circumstances. The following categories describe unique circumstances in which Luventix may use or disclose your PHI:
  • Public Health Activities. Luventix may disclose your PHI to public health authorities or other governmental authorities for purposes including preventing and controlling disease, reporting child abuse or neglect, reporting domestic violence and reporting to the Food and Drug Administration regarding the quality, safety and effectiveness of a regulated product or activity. Luventix may, in certain circumstances disclose PHI to persons who have been exposed to a communicable disease or may otherwise be at risk of contracting or spreading a disease or condition.
  • Workers’ Compensation. Luventix may disclose your PHI as authorized by, and to the extent necessary to comply with, workers’ compensation programs and other similar programs relating to work-related illnesses or injuries.
  • Health Oversight Activities. Luventix may disclose your PHI to a health oversight agency for authorized activities such as audits, investigations, inspections, licensing and disciplinary actions relating to the healthcare system or government benefit programs.
  • Judicial and Administrative Proceedings. Luventix may disclose your PHI, in certain circumstances, as permitted by applicable law, in response to an order from a court or administrative agency, or in response to a subpoena or discovery request.
  • Law Enforcement. Luventix may, under certain circumstances, disclose your PHI to a law enforcement official, such as for purposes of identifying or locating a suspect, fugitive, material witness or missing person.
  • Decedents. Luventix may, under certain circumstances, disclose PHI to coroners, medical examiners and funeral directors for purposes such as identification, determining the cause of death and fulfilling duties relating to decedents.
  • Organ Procurement. Luventix may, under certain circumstances, use or disclose PHI for the purposes of organ donation and transplantation.
  • Research. Luventix may, under certain circumstances, use or disclose PHI that is necessary for research purposes.
  • Threat to Health or Safety. Luventix may, under certain circumstances, use or disclose PHI if necessary to prevent or lessen a serious and imminent threat to the health or safety of a person or the public.
  • Specialized Government Functions. Luventix may, in certain situations, use and disclose PHI of persons who are, or were, in the Armed Forces for purposes such as ensuring proper execution of a military mission or determining entitlement to benefits. Luventix may also disclose PHI to federal officials for intelligence and national security purposes.

Your Rights Regarding Your PHI.

You have the following rights regarding the PHI maintained by Luventix:

  • Confidential Communication. You have the right to receive confidential communications of your PHI. You may request that Luventix communicate with you through alternate means or at an alternate location, and Luventix will accommodate your reasonable requests.
  • Restrictions. You have the right to request restrictions on certain uses and disclosures of PHI for treatment, payment or healthcare operations. You also have the right to request that Luventix restrict its disclosures of PHI to only certain individuals involved in your care or the payment of your care. You must submit your request in writing to Luventix. Luventix is not required to comply with your request. However, if Luventix agrees to comply with your request, it will be bound by such agreement, except when otherwise required by law or in the event of an emergency.
  • Inspection and Copies. You have the right to inspect and copy your PHI. You must submit your request in writing to Luventix. Luventix may impose a fee for the costs of copying, mailing, labor and supplies associated with your request. Luventix may deny your request to inspect and/or copy your PHI in certain limited circumstances. If that occurs, Luventix will inform you of the reason for the denial, and you may request a review of the denial.
  • Amendment. You have a right to request that Luventix amend your PHI if you believe it is incorrect or incomplete, and you may request an amendment for as long as the information is maintained by Luventix. You must submit your request in writing to Luventix and provide a reason to support the requested amendment. Luventix may, under certain circumstances, deny your request by sending you a written notice of denial. If Luventix denies your request, you will be permitted to submit a statement of disagreement for inclusion in your records.
  • Accounting of Disclosures. You have a right to receive an accounting of all disclosures Luventix has made of your PHI. However, that right does not include disclosures made for treatment, payment or healthcare operations, disclosures made to you about your treatment, disclosures made pursuant to an authorization, and certain other disclosures. You must submit your request in writing to Luventix and you must specify the time period involved (which must be for a period of time less than six years from the date of the disclosure). Your first accounting will be free of charge. However, Luventix may charge you for the costs involved in fulfilling any additional request made within a period of 12 months. Luventix will inform you of such costs in advance, so that you may withdraw or modify your request to save costs.
  • Breach Notification. You have the right to be notified in the event that Luventix (or a Luventix Business Associate) discovers a breach of unsecured PHI.
  • Paper Copy. You have the right to obtain a paper copy of this Notice from Luventix at any time upon request. To obtain a paper copy of this notice, please contact Luventix by calling (800) 404-3143.
  • Complaint. You may complain to Luventix and to the Secretary of the Department of Health and Human Services if you believe that your privacy rights have been violated. To file a complaint with Luventix, you must submit a statement in writing to Luventix: Attn: Security Officer, 44 Canyon Shores Place, Henderson, NV 89011. Luventix will not retaliate against you for filing a complaint.
  • Further Information. If you would like more information about your privacy rights, please contact Luventix by calling (800) 404-3143 and ask to speak to the Privacy and Security Officer. 11. Security

We maintain reasonable technical and organizational measures to protect personal information from loss, misuse, alteration, or unintentional destruction. We have implemented various security measures to protect both the personal information and the general information that we receive from you through the Service. Whenever you give out personal information online there is a risk that third parties may intercept and use that information. Although we seek to protect your personal information and privacy, we cannot guarantee the security of any information you disclose online. To the extent permitted under applicable law, we assume no liability or responsibility for disclosure of your information due to errors in transmission, unauthorized access by third parties, or other causes beyond our control.

This Privacy Policy is effective as of the date at the top of this policy. Luventix has the discretion to update this Privacy Policy at any time. When we do, we will revise the effective date at the top of this page. We encourage users to frequently check this page for any changes and to stay informed about how we are helping to protect the personal information we collect, especially before you provide information, and particularly personal information, directly to us through the Service. In the event of a material change to this Privacy Policy, we will provide a message through our website or via email informing you of the change.
